5. PRODUCTS, MATERIALS & SERVICES
a) Authenticity & Vintage Condition. Many of our items are vintage, antique, one-of-a-kind, or reclaimed. Patina, wear, color variation, chipping, tool marks, and dimensional variance are inherent and celebrated characteristics—not defects. Each piece is sold as-is and is final sale unless expressly stated otherwise in writing.
b) Natural Stone & Hand-Made Variation. Stone (e.g., limestone, onyx, marble, travertine) and hand-finished goods will vary in color, veining, porosity, fossils, fill, finish, and dimensions. Samples, photos, and videos are representative only. Sealing and maintenance may be required and are the customer’s responsibility unless a written service agreement states otherwise.
c) Custom & Made-to-Order. Lead times and specifications will be stated on your quote/invoice. Deposits are non-refundable. Once production begins, orders cannot be canceled or altered without our written approval and may incur additional charges.
d) Live Plants. Live goods are final sale. We provide basic care guidance; long-term health depends on environment and care outside of our control. We do not guarantee plant lifespan unless a separate written maintenance agreement is purchased.
e) Colors & Display. We attempt to display colors/images accurately, but cannot guarantee your screen’s accuracy.
f) Quantity & Availability. We may limit sales by person, household, region, or jurisdiction; limit quantities; discontinue products; or refuse orders at our discretion.
g) Design, Delivery & Installation Services. Where provided, services (including site visits, staging, placement, build-outs, and fountain/lighting) are billed as quoted. Unless expressly stated otherwise, balances are due at or before delivery/installation. If we agree to return for adjustments, scheduling occurs after the outstanding balance is paid.
We do not warrant that products or services will meet every expectation, or that errors will be corrected.

6. BILLING & ACCOUNT INFORMATION
We may refuse or cancel any order. We may limit or cancel quantities per person, household, or order (including orders using the same account, card, or address). If we change or cancel an order, we may attempt to notify you using the contact details provided at checkout.
You agree to provide current, complete, and accurate purchase and account information, and to promptly update details (email, billing, and payment info) so we can complete transactions.

RETURNS, EXCHANGES & CANCELLATIONS
Final Sale. Due to the nature of vintage/antique items, custom fabrication, natural stone variation, and live plants, all sales are final unless we expressly agree otherwise in writing prior to purchase. If an exception is granted, restocking fees, two-way freight, and repair costs may apply. Custom orders and deposits are non-refundable.
Chargebacks used to circumvent these Terms may be contested with documentation of approval, delivery, and acceptance.
PRIVACY & PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy (see link in footer). Please review it to understand how we collect and use data.

12. ERRORS, INACCURACIES & OMISSIONS
Occasionally there may be information on the site or within the Service that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, shipping charges, transit times, availability). We reserve the right to correct or update information or cancel orders if any information is inaccurate, at any time and without notice (including after you submit an order).

To the fullest extent permitted by law, Trouvaille Imports, its officers, directors, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Service or any products, even if advised of the possibility of such damages. Where limitations are not allowed, our liability shall be limited to the maximum extent permitted by law.

Obligations and liabilities incurred prior to termination survive termination. These Terms are effective unless and until terminated by either party. You may terminate by ceasing use of the site and notifying us. If we believe you have violated these Terms, we may terminate access without notice and you remain liable for amounts due up to and including the date of termination.

These Terms and any separate agreements under which we provide you Services are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that the exclusive venue for any action shall be the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there.

We are not liable for delays or failures to perform due to events beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, transportation failures, or governmental actions.
